Former Executive Vice President of Unilever Ghana and Nigeria, Yaw Nsarkoh, has asserted that expanding the judiciary and appointing additional judges will not resolve Ghana’s systemic legal challenges unless the root causes of civil friction and disputes within society are directly addressed.
Speaking at a joint event hosted by JoyNews and the Amalgam of Professionals, Mr. Nsarkoh argued that the country’s courts are continually overwhelmed by downstream consequences because policymakers fail to address fundamental governance and structural problems. He highlighted persistent land litigation, chieftaincy disputes, and funeral-related conflicts as primary drivers of court backlogs, emphasizing that outsourcing these societal failures to underfunded courts is an ineffective strategy.
The prominent industrialist questioned whether adequate factor analysis is being conducted to understand why litigation rates remain excessively high across specific sectors. He advocated for comprehensive land reforms, systematic dispute resolution mechanisms, and the strategic integration of technology to streamline administrative systems and address governance deficits at their source rather than relying solely on judicial expansion.
